Do You Need to Use Vacation Days for Workers Comp Doctors Appointments?

December 6, 2022 by James Hoffmann

Given the issues that follow a workplace injury, it’s important to have professional legal representation to ensure that your rights are protected.

Unfortunately, not all employers have clear and detailed policies and procedures regarding workers’ comp and what to do after one has been involved in a work-related injury. This can lead to confusion and questions that are often difficult to answer. One such question is whether injured workers must use vacation days for doctor’s appointments.

In this article, we’ll discuss whether workers need to use vacation days for doctor’s appointments after a work injury.

Vacation Time and Medical Treatment After a Work Injury

Naturally, after suffering a work-related injury, you’ll generally need medical treatment to ensure a full and speedy recovery. Unfortunately, in some cases, these treatments call for regular visits to the doctor or specialist appointments.

In this case, you may take some time off work, say two times a week, to attend these appointments. Unfortunately, your constant absence from work to go for a doctor’s appointment may be met with resistance from your employer. They may try to force you to use your well-deserved vacation days for these appointments or, worse, to cover the time off.

Is This Legal?

If you had not sustained an injury while doing your job, you could not be in your current situation. If your employer is trying to make you use vacation time for injury treatment, you should talk to a Missouri workers’ comp attorney to discuss your options.

What Are My Options?

If your injuries are severe and make it difficult to get to a doctor’s appointment, then your employer may be required to provide paid time off for medical appointments related to a work injury.

Alternatively, you can try and get an appointment after work. This way, you’ll avoid burdening your employer with personal errands during work hours while ensuring that your treatment is on track and that you can speed up your recovery. Talk to your doctor or specialist to schedule an appointment during your after-work hours, and make sure you keep up with your treatment.
