Workers’ Comp Insurance Is Generally Mandatory

Under Missouri jurisdiction, workers’ compensation insurance is mandatory for employers with five or more employees. Failure to carry workers’ comp can result in fines and penalties, as well as increased workers’ compensation rates and premiums.

Eligibility for Workers Comp Benefits Start On the First Day of Work

Generally, employees are eligible for workers’ comp benefits as soon as they start working. This is different from other benefits where employees must have been working for a certain period before they’re eligible.

Workers’ Comp Covers Long-Term Illnesses and Injuries

The Missouri worker’s compensation system generally provides coverage for both short-term and long-term illnesses and injuries. This means that employees who suffer from a workplace injury or illness will usually be able to receive benefits for the duration of their injury or illness.

Employers Can Be Sued for Workplace Injuries

While Missouri worker’s comp is a no-fault system, employees can still sue their employer if they were intentionally harmed.

Stress-Related Injuries May Qualify For Workers’ Comp

There is a common misconception that workers’ comp does not cover stress and anxiety. However, this is generally not true. If a worker can prove that their job caused them stress and it’s affecting their physical or mental health, they may be eligible for workers’ comp benefits.

Some Injuries Don’t Qualify for Workers’ Comp

Some injuries are not covered under workers’ compensation. This includes:

  • Any intentional injuries
  • Injuries suffered while committing a serious crime at the workplace
  • Injuries that occur while off duty
  • Injuries caused by intoxication
  • Injuries caused by horseplay

The Workers’ Comp System Is Designed to Protect Workers and Employers Alike

Worker’s Comp laws protect both employees from being financially burdened by medical expenses related to a workplace injury, as well as employers from frivolous lawsuits. In addition, many companies have lower insurance rates if they carry workers’ compensation insurance.

Some Workers Are Exempt From Workers’ Compensation

In Missouri, certain employees are exempt from workers’ compensation. This generally includes:

Casual employees: This applies to domestic workers employed by homeowners like babysitters, gardeners, and housekeepers, as well as farm laborers hired on an occasional basis.

Volunteers: This includes unpaid volunteers for nonprofit organizations or government entities.
